A Chapter 13 bankruptcy case can be filed within 20 minutes if it becomes necessary to stop for example a foreclosure or repossession, however, you must have a credit counseling certificate in order to file.

Emergency Chapter 13 Bankruptcy Filings

Chapter 13 emergency filings are not done by all attorneys for good reasons. I causes much more work then a regular filing where everything is prepared with sufficient time. An emergency filing only includes the bankruptcy petition, a preliminary list of creditors, and the social security statement. All other schedules and statements have to be filed withing 14 days. Our office who serves clients in the St. Louis and Metro East area does provide emergency help to our clients. One of the must have requirements in order to file is the credit counseling certificate. You can do this over the phone or through the internet. Doing in through the internet is the cheapest way. However, you cannot just use any credit counseling agency, it must be one that is admitted in the bankruptcy district you will file your bankruptcy petition in.
