There are several types of bankruptcy. They are named after the statutory titles of the U.S. Bankruptcy Code under which they are organized. The two major types of bankruptcy used by individuals are Chapter 7 and Chapter 13.
Chapter 7 bankruptcy is also known as "liquidation" or "straight" bankruptcy. It is designed to provide a fresh start for businesses or individuals whose assets and income are insufficient to pay their debts. In a Chapter 7 bankruptcy you can get rid of unsecured debts such as credit card bills, medical bills and payday loans.
Chapter 13 bankruptcy is available to individuals with a regular income. The debtor must set up a payment plan to repay creditors over a three to five year period. Chapter 13 bankruptcy stops foreclosures and repossession. At the completion of the payment period, the debtor receives a discharge of their debts.
Not all debt is covered by bankruptcy laws. Educational loans, alimony, child support, punitive fines and certain other debts may not be discharged even if you declare bankruptcy.
