Forms Required for Filing Bankruptcy – Chapter 7

There are a number of documents that you will have to complete and file in a Chapter 7.

A Chapter 7 case is started by filing a completed Voluntary Petition form. This is the official court form that asks basic information including:

  • Name, address and social security number
  • Type of bankruptcy you are filing (Chapter 7, 11, 12 or 13)
  • Type of debtor you are (Individual, corporation, partnership)
  • Whether your debts are primarily consumer or business
  • If you are a business debtor, the type of business
  • How you will be paying for your filing fee
  • Estimated number of creditors
  • Estimated amount of your debts
  • Estimated value of your property
  • Whether there are any nonexempt assets
  • Your history of bankruptcy filings
  • Whether you have completed your credit counseling certificate

Additional documents must be filed within 14 days after the filing of the petition. However, the best practice is to file all of the documents when the petition is filed so that the case is kept under control and to ensure that the deadline is not missed. The documents that must be filed within 14 days include:

  • List of all creditors including names, mailing addresses and account numbers (known as the creditor matrix)
  • List of all of your assets including real property and personal property
  • A schedule of liabilities including secured creditors, unsecured creditors and property creditors,
  • Statement of financial affairs for the two years prior to the filing date of the petition
  • Schedule of current income and current expenses
  • A certificate stating that you have received a notice explaining your duties under the bankruptcy law and the consequences of being untruthful  or providing incomplete information
  • Paystubs for the 60 days prior to the filing of the bankruptcy
  • Statement of your average monthly gross income over the previous 6 months and a means test calculation if your income exceeds the median income for your household size set for your state
  • Certificate showing that you received credit counseling from an authorized provider within 6 months prior to the filing of the bankruptcy
  • Copy of most recent tax return
  • Schedule indicating which assets you are claiming as exempt
  • Schedule of executor contracts and leases your have signed
  • Schedule of any codebtors
  • Form called Statement of intention
